Terms and Conditions for Goa Open Water Swimming Club event Registration
Please read these Terms and Conditions carefully before completing your registration for events organized by the Goa Open Water Swimming Club. By registering for the Event, you agree to be bound by these Terms and Conditions.
1. Eligibility and Participation
Age Restriction: Participants must be at least [Minimum Age, e.g., 18] years of age on the day of the Event. Participants under 18 must have a completed parental/guardian consent form and may require direct supervision by a responsible adult during the Event.
Medical Fitness: Participants must be medically fit to participate in open water swimming. You declare that you do not have any medical conditions, injuries, or disabilities that would prevent you from safely participating in the Event. If you have any doubts about your medical fitness, please consult a doctor before registering.
Swimming Ability: Participants must be competent and confident open water swimmers for Destination Swims. You must be able to comfortably swim the advertised distance of the Event without assistance. The Club reserves the right to remove any participant from the water who, in the opinion of Event officials, poses a risk to their own safety or the safety of others. For Introduction camps and private sessions, participant should be able to swim 50m unassisted.
Equipment: Participants are responsible for providing their own suitable swimming equipment (e.g., rash vest, goggles, swim cap).
2. Registration and Payment
Registration Process: Registration for the Event will be conducted online via www.goaopenwaterswimmingclub.com . All required fields in the registration form must be completed accurately and truthfully.
Payment: Payment must be made in full at the time of registration through the designated payment gateway. Registrations will not be confirmed until full payment has been received.
Confirmation: Upon successful registration and payment, you will receive a confirmation email to the address provided during registration. Please check your spam folder if you do not receive it.
3. Cancellations, Refunds, and Transfers
Participant Cancellation:
Cancellations made upto 5 days or more prior to the Event date will be eligible for a 70% refund of the registration fee.
Cancellations made less than 5 days prior to the Event date are non-refundable.
All refunds will be made within 14 days after the event.

Event Cancellation by the Club: In the unlikely event that the Club is forced to cancel the Event due to unforeseen circumstances beyond its control (e.g., extreme weather conditions, government restrictions, safety concerns), participants will be offered:
70% refund of the registration fee.
The option to transfer their registration to a future Club event withing the season, if available.
The Club will make every effort to notify participants of any cancellation as soon as possible via email and/or social media.
Transfers: Registrations are generally non-transferable to another individual. In exceptional circumstances, and at the sole discretion of the Club, a transfer may be considered. An administrative fee may apply.
4. Event Rules and Safety
Safety Briefing: All participants are required to attend the mandatory safety briefing prior to the start of the Event. Important information regarding the course, safety procedures, and emergency protocols will be provided.
Marshals and Officials: Participants must comply with all instructions given by Event marshals, safety personnel, and Club officials. Their decisions are final.
Safety Cover: The Club will endeavor to provide appropriate safety cover for the Event, including kayaks, paddleboards, and/or motorized vessels, with trained personnel.
Withdrawal from Event: If you feel unwell or unable to continue during the Event, you must notify a safety marshal immediately. The Club reserves the right to withdraw any participant from the water if, in the opinion of Event officials, their safety is at risk.
No Personal Support Vessels: Personal support vessels are strictly prohibited on the Event course.
Environment: Participants are expected to respect the open water environment. Do not litter, and be mindful of local marine life and flora.
5. Waiver and Release of Liability
By registering for and participating in the Event, you acknowledge and agree that:
Open water swimming carries inherent risks, including but not limited to, drowning, hypothermia, injuries from marine life, currents, and adverse weather conditions.
You voluntarily assume all risks associated with your participation in the Event.
To the fullest extent permitted by law, you hereby release, waive, and discharge the [Your Open Water Swimming Club Name], its organizers, volunteers, sponsors, officials, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, whether caused by the negligence of the Club or otherwise, while participating in the Event.
You agree to indemnify and hold harmless the Club from any loss, liability, damage, or costs, including attorney’s fees, that they may incur due to your participation in the Event, whether caused by negligence or otherwise.
6. Image Rights
You acknowledge that photographs and videos may be taken during the Event by the Club or its authorized photographers/videographers.
By registering, you grant the [Your Open Water Swimming Club Name] the irrevocable right and permission to use photographs and/or videos of you, or in which you may be included, for promotional, marketing, and archival purposes related to the Club and its future events, without further compensation or notification. This includes, but is not limited to, use on the Club's website, social media, and marketing materials.
If you do not wish for your image to be used, please notify the Club in writing via [Your Club Email Address] prior to the Event.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, and any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in [Your City/State in India].
8. Amendments to Terms and Conditions
The Club reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the Club's website and will be effective immediately upon posting. It is your responsibility to review these Terms and Conditions periodically for updates.

When you register for a GOWSC event, we may collect the following types of personal information:

Club Operations: For internal record keeping, analysis of participation trends, and improvement of our events and services.
Marketing and Promotion: To promote future Club events and activities through our website, social media, and newsletters, using aggregated data or images where permission is granted.
Legal Compliance: To comply with applicable laws, regulations, and legal processes.
3. How We Share Your Information
We will not sell, rent, or lease your personal information to third parties. We may share your information in the following limited circumstances:
Event Safety Personnel: Your name, emergency contact, and relevant medical information may be shared with Event safety personnel (e.g., lifeguards, medical staff) to ensure your safety during the Event.
Third-Party Service Providers: We may engage trusted third-party service providers (e.g., online registration platforms, payment gateways) to assist us in operating our events. These providers are obligated to protect your information and only use it for the purposes for which we disclose it to them.
